CITY OF LAFAYETTE RESOLUTION NO. 2021-19 A RESOLUTION AUTHORIZING TITLE AND SUMMARY PUBLICATION OF ORDINANCE 134 WHEREAS, the City of Lafayette has enacted Ordinance 134 entitled: AN ORDINANCE AMENDING CODE TITLE 9, REGULATION OF NUISANCES; and WHEREAS, Minnesota Statutes 412.191 subd. 4 requires new ordinances to be published once in the official newspaper of the city; and WHEREAS, Ordinance 134 is 6 pages long, and thereby too lengthy for full publication; and WHEREAS, Minnesota Statutes 412.191 subd. 4 allows for publication of the title and a summary of an ordinance that is too lengthy for full publication; THEREFORE, BE IT RESOLVED, by the Council of the City of Lafayette: 1. The title and a summary of Ordinance 134 shall be published, conforming to Minnesota Statute section 331A.01, subdivision 10, with notice that a printed copy of the ordinance is available for inspection by any person during regular office hours at the office of the city clerk and via electronic mail. 2. A copy of the entire text of Ordinance 134 shall be posted by the City Council. 3. The council hereby approves the following text for publication of the title and summary, and hereby determines that it clearly informs the public of the intent and effect of the ordinance: TO WHOM IT MAY CONCERN: THE CITY OF LAFAYETTE HAS ENACTED ORDINANCE #134: AN ORDINANCE AMENDING CODE TITLE 9, REGULATION OF NUISANCES. Minnesota Statutes 412.191 subd. 4 allows for publication of the title and a summary of an ordinance that is too lengthy for full publication. The City Council of the City of Lafayette has determined that summary publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance. A printed copy of the ordinance is available for inspection by any person during regular office hours at the office of the city clerk and via electronic mail. The following is a summary of Ordinance 134: 1. § 92.09 ABATEMENT, provides the process for abatement of nuisances, and theassessment of the costs of the abatement. 2 .§ 92.35 SHORT TITLE, established a title for a subchapter of the City code called the“Weed Ordinance.” 3. § 92.36 JURISDICTION, addresses jurisdiction of the ordinance. 4. § 92.37 DEFINITIONS; EXCLUSIONS, provides definitions and exclusions to the ordinance. 5. § 92.38 OWNERS RESPONSIBLE FOR TRIMMING, REMOVAL AND THE LIKE, established the responsibilities for cutting and disposal of weeds. 6 .§ 92.39 FILING COMPLAINT, established the complaint initiation process for nuisance weeds within the City. 7. § 92.40 NOTICE OF VIOLATIONS, established the process of notification for violations of the ordinance. 8. § 92.41 APPEALS, establishes an appeal process for a property owner who disagrees with a notice of violation. 9. § 92.42 ABATEMENT BY CITY, provides authorization for the City to abate nuisance weeds. 10. § 92.43 LIABILITY, provides that the property owner is liable for all costs of removal, cutting or destruction of weeds as defined by this code subchapter. The Petition represents that the Decedent died more than three years ago, leaving property in Minnesota and requests the probate of Decedent’s last Will (if any), and the descent of such property be determined and assigned by this Court to the persons entitled to the property. Any objections to the Petition must be filed with the Court prior or raised at the hearing. If proper, and no objections are filed or raised, the Petition may be granted.
