Board Chair Merkel called the Work Session to order at 6:02 p.m. on May 6, 2024.

8.  The physical street address, city, and zip code of the mortgaged premises:  Parcel ID 17-3104-000 has not been assigned a street address and is located along 361 st Avenue to the East and 276 th Street to the South, Jessenland Township, Sibley County, Minnesota. Parcel ID 17-3105-000 is located at 27112 361 st Avenue, Henderson, MN 56044 in Jessenland Township, Sibley County, Minnesota. Parcel ID 17-3006.00 has not been assigned a street address and is located directly to the North of Parcel ID’s 17-3104-000 and 17-3105-000 and along 361 st Avenue to the East, Jessenland Township, Sibley County, Minnesota. Parcel ID 17-3110-000 has not been assigned a street address and is located along 361 st Avenue to the East and 276 th Street to the North, Jessenland Township, Sibley County, Minnesota.
INFORMATION REGARDING FORECLOSURE
9. The requisites of Minn. Stat. 580.02, to the extent applicable, have been satisfied.
10.  The original amount of the Judgment entered on September 1, 2023 was $420,290.75.
11. As of the effective date of this notice the amount due on the Judgment is: $466,709.74. Additional attorneys’ fees and costs of $1,300.50 have been incurred since the May 2, 2024 Judgment.
12. Pursuant to decrees of foreclosure in the Findings of Fact, Conclusions of Law, Order for Judgment, and Judgment entered on September 1, 2023 and the Findings of Fact, Conclusions of Law, Order for Judgment, and Judgment entered on May 2, 2024, the Marital Lien will be foreclosed, and the liened premises will be sold, by the Sheriff of Sibley County, Minnesota, at public auction on Thursday, July 11, 2024 at 10:00 a.m. at the Sibley County Sheriff’s Office, 419 Harrison Street, Gaylord, MN 55334. At the foreclosure sale the Sheriff will first sell the Ulmen Farm, and then if the sale of the Ulmen Farm is not sufficient to satisfy the entirety of the Marital Lien, the Sheriff will sell the Ostermann Farm.
13. The time allowed by law for redemption by Defendants or Defendants’ personal representatives or assigns is 12 months after the date of the order confirming the same.
14. Minn. Stat. 580.04(b) provides, “If the real estate is an owner-occupied, single-family dwelling, the notice must also specify the date on or before which the mortgagor must vacate the property if the mortgage is not reinstated under section 580.30 or the property redeemed under section 580.23.” If this statute applies, the time to vacate the property is 11:59 p.m. on July 11, 2025.
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE JUDGMENT DEBTOR, THE JUDGMENT DEBTOR’S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE LIENED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
