A RESOLUTION
AUTHORIZING TITLE AND SUMMARY PUBLICATION OF ORDINANCE 150
WHEREAS, the City of Lafayette has enacted Ordinance 150 entitled: AN ORDINANCE GRANTING TO NORTHERN STATES POWER COMPANY, A MINNESOTA CORPORATION, ITS SUCCESSORS AND ASSIGNS, PERMISSION TO CONSTRUCT, OPERATE, REPAIR AND MAINTAIN IN THE CITY OF LAFAYETTE, MINNESOTA, AN ELECTRIC DISTRIBUTION SYSTEM AND TRANSMISSION LINES, INCLUDING NECESSARY POLES, LINES, FIXTURES AND APPURTENANCES, FOR THE FURNISHING OF ELECTRIC ENERGY TO THE CITY, ITS INHABITANTS, AND OTHERS, AND TO USE THE PUBLIC GROUNDS AND PUBLIC WAYS OF THE CITY FOR SUCH PURPOSES; and
WHEREAS, Minnesota Statutes 412.191 subd. 4 requires new ordinances to be published once in the official newspaper of the city; and
WHEREAS, Ordinance 150 is 6 pages long, and thereby too lengthy for full publication; and
WHEREAS, Minnesota Statutes 412.191 subd. 4 allows for publication of the title and a summary of an ordinance that is too lengthy for full publication;
THEREFORE, BE IT RESOLVED, by the Council of the City of Lafayette:
1. The title and a summary of Ordinance 150 shall be published, conforming to Minnesota Statute section 331A.01, subdivision 10, with notice that a printed copy of the ordinance is available for inspection by any person during regular office hours at the office of the city clerk and via electronic mail.
2. A copy of the entire text of Ordinance 150 shall be posted by the City Council.
3. The council hereby approves the following text for publication of the title and summary, and hereby determines that it clearly informs the public of the intent and effect of the ordinance:

Minnesota Statutes 412.191 subd. 4 allows for publication of the title and a summary of an ordinance that is too lengthy for full publication. The City Council of the City of Lafayette has determined that summary publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance. A printed copy of the ordinance is available for inspection by any person during regular office hours at the office of the city clerk and via electronic mail.
The following is a summary of Ordinance 150:
1. Section 1. Definitions, provides the definitions for terms in the ordinance.
2. Section 2. Adoption of Franchise, provides a grant of franchise for a term of 20 years with the Company, along with the effective date, service and rates, reimbursement of publication expenses, and terms for dispute resolution.
3. Section 3. Location and other regulations, provides rules for the locations of facilities, field locations, street openings and restoration, avoiding damage, notice of improvements, and shared use of poles.
4. Section 4. Relocations provides rules for the relocation of electric facilities in public rights-of-way, in the ground, and relation to federal funding.
5. Section 5. Tree trimming, provides rules for trimming of trees when needed.
6. Section 6. Indemnification, provides rules for when the Company shall indemnify the City.
7. Section 7. Vacation of Public Ways, provides for notices to be provided in the event of a proposed vacation of a public right-of-way.
8. Section 8. Change of Government, provides that a change in the form of government of the City shall not affect the validity of the ordinance.
9. Section 9. Provision of Ordinance, provides for severability of terms of the ordinance and limitation of applicability of the ordinance to between the City and Company.
10. Section 10. Amendment Procedure, provides the amendment procedure for amending the ordinance.
11. Section 11. Previous Franchises Superseded, provides that the ordinance supersedes any previous franchise agreement between the parties.

WHEREAS, Minnesota Statutes 412.191 subd. 4 requires new ordinances to be published once in the official newspaper of the city; and
WHEREAS, Ordinance 151 is 5 pages long, and thereby too lengthy for full publication; and
WHEREAS, Minnesota Statutes 412.191 subd. 4 allows for publication of the title and a summary of an ordinance that is too lengthy for full publication;
THEREFORE, BE IT RESOLVED, by the Council of the City of Lafayette:
1. The following is a summary of Ordinance 151:
1. Section 1 adds Code section 151.007, which provide the following subsections relating to the regulation and zoning of cannabis business within the City:
(A) Administration (1) Findings and Purpose for regulating cannabis businesses; (2) legal authority and jurisdiction of the City; (3) a severability clause; (4) provisions for enforcement of the ordinance; and (5) provision of definitions for the ordinance;
(B) provides for registration of Cannabis Businesses, and delegates the registration authority to Nicollet County, including compliance checks, and a limitation on the number of cannabis businesses allowed to be registered.
(C) Requirements for Cannabis Businesses, provides: (1) Minimum Buffer Requirements; prohibiting the operation of a Cannabis Retail Businesses within 1,000 feet of a school, or within 500 feet of a day care, residential treatment facility, or an attraction within a public park that is regularly used by minors, including a playground or athletic field; (2) Zoning and Land Use, limiting the zone(s) that Cannabis businesses may operate in, either as permitted or conditional uses; (3) Hours of Operation for Cannabis businesses are limited to retail sale of cannabis products between the hours of 10 a.m. and between 9 p.m. every day; (4) limiting when and where Temporary Cannabis Events may occur.
2. Section 2. Provides that certain Cannabis Businesses may operate in the City’s commercial, industrial and agricultural zoning districts either as permitted uses, or with a conditional use permit, depending on the type of Cannabis Business.

REGARDING ASSESSMENT AND CLASSIFICATION OF PROPERTY
This may affect your 2025 property tax payments.
Notice is hereby given that the Board of Appeal and Equalization of Bismarck Township shall meet on Tuesday, April 22nd, 2025 at 10:00 a.m., at Lyle Forst, Supervisor’s home, 60881 270 St, Gibbon, MN 55335. The Purpose of this meeting is to determine whether taxable property in the jurisdiction has been properly valued and classified by the assessor, and also to determine whether corrections need to be made.
If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you are still not satisfied with the valuation or classification after discussing it with your assessor, you may appear before the local board of appeal and equalization. The board shall review the valuation, classification or both if necessary, and shall correct it as needed. Generally, an appearance before your local board of appeal and equalization is required by law before an appeal can be taken to your county board of appeal and equalization.

REGARDING PROPERTY ASSESSMENTS
This may affect your 2026 property taxes.
The Board of Appeal and Equalization for the City of Lafayette in Nicollet County, Minnesota will meet at the Council Chambers, 791 Main St. at 6:30 pm on Monday the 14th day of April 2025. The purpose of this meeting is to determine whether property in the jurisdiction has been properly valued and classified by the assessor.
If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns. If you disagree with the valuation or classification after discussing it with your assessor, you may appear before the local board of appeal and equalization. NOTICE OF GRAVEL BIDS
Notice is hereby given that the Town Board of Bismarck Township, Sibley County, will accept bids for 4,500 cubic yards, more or less, of Class 5 or better gravel until 7 P.M. on Monday, April 14th, 2025 when the bids will be opened at the regular township meeting.
Bids will be accepted for any of the following:
1. The whole Township
2. Only the North Half (North of County Road #10)
3. Only the South Half (South of County Road #10)
The bid is to include the name and location of the pit, the cost of the gravel, loading and hauling and is to be delivered NO LATER THAN JULY 31.
`Also, if there is a fuel surcharge, please list this separately.
All bids must be accompanied by a certified check in the amount of 5% of the bid, and a Certificate of Insurance for Workmen’s Compensation and Employer’s Liability Coverage.
The gravel is to be delivered according to Gravel Maps that will be furnished by the Township.
The Board reserves the right to reject any or all bids, to waive any irregularities, and to award the bid in the best interest of the Township.

Gravel Contractors
Notice is hereby given that the Town Board of Transit Township will be receiving Bids for loading and hauling of 4000 tons, more or less, of Class #5 gravel to be delivered to any road in Transit Township. Bids are to be received by the Town Clerk by Noon Monday, April 7, 2025, and will be opened at 8:00 pm., Monday, April 7, 2025. The gravel to be hauled before July 15, 2025. A 5% Bid Bond and a Certificate of Insurance are to accompany the Gravel Bid. Any questions contact the Town Clerk.
